The concept of separation of powers is not new. Its roots date back to antiquity, being discussed by philosophers such as Aristotle in his work Politics . However, the modern theory was developed in the 18th century by Montesquieu in The Spirit of the Laws , where he proposed the division into three independent spheres to avoid abuse of authority.

This separation aims to decentralize power, which was previously concentrated in absolutist governments, and guarantee the autonomy of each instance. In Brazil, this structure is enshrined in the Federal Constitution of 1988, which establishes the independent and harmonious functioning of the Three Powers: Legislative, Executive and Judiciary.
