On March 1, the Federal Law "On Amendments to the Federal Law "On Information, Information Technologies and Information Protection" dated December 29, 2022 No. 584-FZ will come into force. The requirements of the new law apply to owners of classified ad services with traffic of more than 100 thousand users. Now, only Russian legal entities with a shareholding of at least 50% or individuals - citizens of Russia who do not have citizenship of another state can act as owners of classified ad services.
The law introduces a ban on the use of advertisement posting services for the purpose of committing criminal offenses, disclosing information constituting a state secret, distributing materials containing public calls to commit terrorist activities or publicly justifying terrorism, other extremist materials, as well as materials promoting pornography, violence and cruelty, and materials containing obscene language.
The law specifically stipulates a ban on the distribution on resources with advertisements of information for the purpose of discrediting a citizen or certain categories of citizens on the basis of gender, age, race or nationality, language, attitude to religion, profession, place of residence and work, as well as in mexico mobile number database connection with their political beliefs.
A requirement has been introduced to comply with the prohibitions and restrictions provided for by the Russian Federation legislation on referendums and the Russian Federation legislation on elections, to respect the rights and legitimate interests of citizens and organizations, including the right to honor, dignity and business reputation of citizens, and the business reputation of organizations.
Owners of ad placement services must now indicate their email address, as well as their last name and initials (for individuals) or name (for legal entities) on their websites. Owners of ad placement services are required to use the service offered by Roskomnadzor to track user traffic. Moreover, ad placement service websites must provide the ability to log in via "Gosuslugi". Roskomnadzor will monitor the activities of ad placement services for compliance with the law.
Violation of the requirements of the law by the owner of the service for posting advertisements entails criminal, administrative or other liability in accordance with the legislation of the Russian Federation. Moreover, in case of violation of the law, Roskomnadzor has the right to file a claim in court to restrict access to the resource.
A representative of the press service of Roskomnadzor explained to ComNews that the obligations of the owner of the ad placement service are established by Article 10.7 of Federal Law No. 149-FZ "On Information, Information Technologies and the Protection of Information". "In accordance with Part 12 of Article 10.7 of the law, Roskomnadzor may apply to the court with a request to restrict access to the ad placement service in the following cases: failure by the service owner to comply with the requirements provided for in Parts 6-8 of Article 10.7, repeated failure by the service owner within a year to comply with the requirements to eliminate violations established by a resolution on an administrative offense that has entered into legal force. In addition, in accordance with Article 13.41 of the Code of Administrative Offenses of the Russian Federation, the owner of the ad service may be brought to administrative responsibility for failure to remove prohibited information," the representative of the press service of the department said.
