Understand the secret budget and its implications

Since the end of 2020, there has been a lot of news about the so-called “secret budget”. The latest moves by the presidency and leaders in Congress have revealed how the secret budget is an important means of maintaining supporters of the current government. Recently, the president of the Republic assigned deputies and senators control over how a large portion of public resources would be used, contrary to the order of the Supreme Federal Court (STF) on the transparency of transfers.


In the understanding of the STF, the distribution of resources without a technical criterion constitutes a violation of the principles of publicity and impartiality of public administration acts. The trial to resolve the constitutional issue regarding partial compliance with the financial statements and decide whether to release or definitively suspend payment of the amendments to the secret budget has not yet been scheduled to take place. At the moment, the case is awaiting release from Justice Rosa Weber to the President of the Court, Luiz Fux, who will schedule and analyze the issue.
