Victims of cybercrime with data mining actually have the right to receive legal protection, especially from the weak economic class. Forms of legal protection can be in the form of restitution, assistance, or compensation.
However, according to Government Regulation Number 44 of 2008, victims of cybercrime are more appropriately entitled to restitution. The compensation can be in the form of returning property or covering costs.
So, what is the punishment for data theft perpetrators?
First, the perpetrator can be punished if he meets the criteria as stated in Article 30 Paragraph 2 of Law Number 11 of 2008. The contents of this law discuss information and electronic data transactions or known as the ITE Law .
After being reviewed and found to have fulfilled the elements of Article 30 Paragraph 2 of the ITE Law, the perpetrator can be subject to sanctions in accordance with Article 46 Paragraph 2. The sanctions are in the form of a maximum imprisonment of seven years and/or a maximum fine of IDR 700 million.
